Terms of service

1. Who can use Higgins

You must be at least 18 years old and able to enter a binding contract. If you use Higgins for a business, such as managing rental properties, you agree to these terms for that business too.

2. What Higgins is, and what it isn't

Higgins helps you keep a record of your home, including what's in it, its documents and its history. It answers questions from that record, checks your equipment against safety recalls, suggests what your home is likely to need, reminds you when things are due, and lets you share records, book home service pros and order supplies.

Higgins is an information and organizing tool. Please keep these limits in mind:

• We don't do the work. Higgins isn't a contractor, and we don't inspect, repair or maintain your home.
• Not professional advice. Nothing in Higgins is engineering, inspection, legal, tax or financial advice. Talk to a qualified professional before making decisions that depend on it.
• Estimates, not quotes. Cost ranges and timing in your plan are estimates. A home value shown in Higgins is an estimate, not an appraisal.
• AI can be wrong. Higgins uses AI to read labels and documents and to answer questions. It can misread or make mistakes, so check important details before you act on them.
• Recall checks have limits. We check the equipment details you give us against recalls published by the U.S. Consumer Product Safety Commission. We can't guarantee we'll find every recall, especially if a label is missing, unreadable or not yet photographed.
• Emergencies. Higgins isn't an emergency service. If you smell gas, see fire or sparks, or have flooding, leave if it's unsafe and call 911 or your utility.

3. Your account

Give us accurate information and keep it up to date. Higgins signs you in with links sent to your email or through Google, so keep your email account secure. You're responsible for what happens under your account. Tell us right away at team@gethiggins.com if you think someone else has accessed it.

4. Your content

"Your content" means the information, photos, documents and messages you or people on your home add to Higgins.

• You own your content. You give us permission to store, process, display and use it to provide and improve Higgins, including processing it with the service providers described in our privacy policy.
• You have the right to share it. Only upload content you have the right to upload, and don't upload other people's private information without their permission.
• Records stay with the home. A home's record is shared by the people who have access to that home. If you leave a home, the record stays with it.

5. Household members and sharing

You decide who can see your home's record and what they can do: "See everything", "See and add", or "Everything you can", which includes payments and inviting others. You can change or remove someone's access at any time. When you share records with a pro, they see only what you picked, read only, until the access ends or you stop sharing.

6. Selling or handing over a home

If you sell or hand over a home, you can pass its record to the new owner. The handover happens only when you approve it in Higgins. After you approve, your access to that home ends, and the new owner receives its record.

7. Home service pros

Higgins lets you book our vetted home service pros or share your record with your own contractor.

• Pros are independent. Pros are independent businesses, not our employees or agents. Any agreement for work is between you and the pro, and the pro is responsible for their work, their licenses and their insurance.
• Our vetting has limits. We review the pros we list, but we don't guarantee their work, their prices or their results.
• Problems with a job. If something goes wrong, contact the pro first. Tell us at team@gethiggins.com too, and we'll help where we can.

8. Payments and approvals

Higgins is free to use. You pay only for things you choose to buy, such as supplies, or work you approve from a pro.

• You approve every charge. When a pro sends a charge, you'll see each line and the total before anything happens. When you approve it, you authorize us, through our payment processor Stripe, to charge your payment method for that amount once the job is marked done. Nothing is charged without your approval.
• Payment processing. Payments are processed by Stripe and are subject to Stripe's terms. We don't store your full card number.
• Taxes. Prices may not include applicable taxes, which will be shown before you pay.
• Future fees. If we ever introduce a fee for Higgins itself, we'll tell you in advance, and it will never apply to anything you've already paid for.

9. Supplies

When supply ordering is available, you can order items like filters through Higgins. We'll show the price before you pay. If we can't fulfill an order, we'll refund it in full. Shipping, returns and delivery details are shown at checkout when they apply.

10. Acceptable use

Don't use Higgins to:

• Break the law, or infringe anyone's rights.
• Upload anything harmful, such as malware, or content you don't have the right to share.
• Harass or mislead anyone, including pros and household members.
• Access homes, records or accounts you haven't been given access to, or test or bypass our security.
• Copy, scrape, resell or reverse engineer Higgins, or use it to build a competing product.

11. Our property

Higgins, including its software, design, text, graphics and trademarks, belongs to us or our licensors. These terms don't give you any right to use our name or trademarks. If you send us feedback or ideas, we may use them without owing you anything.

12. Other services

Higgins works with other services, such as Google sign in and Stripe payments. Your use of those services is subject to their own terms, and we're not responsible for them.

13. Ending your account

You can delete your account at any time from your profile or by emailing team@gethiggins.com. We may suspend or close your account if you break these terms or misuse Higgins, and we'll tell you when we can. Sections that by their nature should continue after your account ends will continue, including sections 4, 11 and 14 through 18.

14. Disclaimers

HIGGINS IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON INFRINGEMENT. WE DON'T PROMISE THAT HIGGINS WILL BE UNINTERRUPTED OR ERROR FREE, THAT AI ANSWERS, ESTIMATES OR RECALL CHECKS WILL BE COMPLETE OR ACCURATE, OR THAT ANY PRO'S WORK WILL MEET YOUR EXPECTATIONS.

15. Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, HIGGINS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA OR PROPERTY DAMAGE ARISING FROM YOUR USE OF HIGGINS OR ANY PRO'S WORK. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO HIGGINS IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID TO HIGGINS IN THE 12 MONTHS BEFORE THE CLAIM OR $100. SOME STATES DON'T ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

16. Indemnity

If someone brings a claim against us because of content you uploaded or your violation of these terms or the law, you agree to cover our reasonable costs of dealing with it, including reasonable legal fees, to the extent allowed by law.

17. Disputes

These terms are governed by the laws of the State of California, without regard to its conflict of law rules. If you have a concern, please email team@gethiggins.com first. We'll try to resolve it informally within 30 days. If we can't, any dispute will be resolved in the state or federal courts located in Santa Barbara County, California, and you and we consent to their jurisdiction. Either of us may bring a qualifying claim in small claims court instead.

18. General

• Changes to these terms. If we make material changes, we'll tell you by email or in the app before they take effect. If you keep using Higgins after that, the new terms apply.
• Entire agreement. These terms and our privacy policy are the whole agreement between you and us about Higgins.
• Severability. If part of these terms can't be enforced, the rest still applies.
• No waiver. If we don't enforce a right right away, we haven't given it up.
• Assignment. You can't transfer these terms without our permission. We may transfer them as part of a merger, acquisition or sale of assets.
• Notices. We'll send notices to the email address on your account.
